1. For situations like this we would put the character under the instalment that matches their canonpoint. If you updated in the future to a point where they'd fall under a different canon header, it would be up to you whether they're moved to the new header or not. Since franchises will be under an overall cap regardless, we don't feel this would be too big of a deal.
2. This is covered in the State of the World page under "Health". We did originally list many of these topics under the FAQ, but because the nature of the game means that the answers to these questions will change over time we felt it would be efficient to keep it to its own dedicated page.
To answer your question: as of right now no characters need to eat or drink at all, and there is no distinction between characters' bodily needs. If a need for food of some kind arises later on, all characters will be able to eat the same things.

With how the setting of the game works, we think either option would be fine depending on how you want to play with the idea. By default characters will arrive in whatever state they feel is "normal", so it sounds like Merlin would be more likely to arrive in his Servant body and unable to reach his real body. But as far as abilities go, he would be allowed to regain powers that match his Servant body or his real body, as long as those abilities are detailed on your app. Since all characters will have the option to learn new powers that are introduced to the setting over time, it's reasonable to say Merlin would be able to adapt something similar to his other body's abilities if the opportunity came up.
